INTELLECTUAL PROPERTY GROUP

The Intellectual Property Law and New Technologies Group of Diaz-Bastien & Truan provides consultancy services on a wide range of matters relating to copyright, software, trademark and patent licences, Internet, database protection, protection of personal data (right to privacy), protection of designation of origin, design rights and plant breeders. The Group advises its clients in the design of contracts relating to intellectual property rights, often in the context of international and domestic transactions of great complexity. These include joint ventures, licensing agreements, contracts for production and distribution, data exchange, and research and development.

The Group has many years of experience in advising companies in the sectors of IT, e-commerce, music, film, publishing, radio and television. It also provides its clients with value-added services such as the management of intangible assets and data protection.

The members of the group act in national and international arbitration and administration proceedings relating to domain name conflicts, B2B and B2C e-commerce, advertising regulations, links and content of Web pages. The Group is highly specialised in the use of electronic means for financial services and in highly complex issues relating to unauthorised copies of copyright-protected material, and the transmission and use of personal data abroad.

Group members have extensive experience in representing clients in matters relating to intellectual property before both Spanish and community authorities, as well as before the courts. The group has worked on a number of important matters relating to the submission of documentation and records to authorities in Spain, to the European Commission in Brussels and to the World Intellectual Property Organization (WIPO) in Switzerland.

Group members have advised and represented governments and foreign companies in international negotiations relating to Intellectual Property before the World Intellectual Property Organization and in matters that fall under the World Trade Organization’s Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).
